Agreement
These Terms of Service govern access to benny, including the website, authenticated dashboard, capture links, video walkthroughs, AI-assisted drafting, and related support. By creating an account, using the dashboard, opening a capture link, or otherwise using the service, you agree to these Terms.
If you use benny for a business, you represent that you are authorized to accept these Terms for that business. If a separate written agreement or order form applies, that agreement controls where it conflicts with these Terms.
What benny does
benny helps service businesses collect job-site information through a browser-based video walkthrough. The customer can open a link, grant camera or microphone permission, and show the job. benny may transcribe, analyze, summarize, and structure the capture into a quote draft.
benny does not replace the business owner, estimator, contractor, or professional judgment. Owners are responsible for reviewing every draft, complying with local laws, honoring their customer promises, and deciding what price or scope to send.
Accounts and access
- You must provide accurate account and business information and keep it current.
- You are responsible for activity under your account, including staff or contractors you invite later.
- You must keep login credentials secure and tell us promptly if you believe an account or capture link has been misused.
- You may not share authenticated dashboard access with unauthorized people or use another person's account without permission.
Customer capture links
Businesses may send customers links that open the capture experience. Customers must be told what the link is for and must choose whether to grant camera, microphone, or upload permissions. A customer should only record spaces, people, and property they have the right to show.
Businesses are responsible for customer communications, including SMS, email, consent language, required disclosures, and any laws that apply to sending capture links or follow-up messages.
Videos, images, and other content
You and your customers may upload or record videos, images, audio, notes, prices, business details, customer details, and other materials. You keep ownership of your content, but you grant benny permission to host, process, transmit, display, analyze, and store it as needed to provide and improve the service.
Do not upload content that is unlawful, invasive, discriminatory, infringing, unsafe, or unrelated to a legitimate quote request. Do not intentionally capture children, bystanders, sensitive documents, payment cards, health information, license plates, or private areas unless needed and authorized.
AI output and quotes
AI-generated output can be incomplete, inaccurate, delayed, or wrong. Draft quote ranges, confidence scores, measurements, hazard flags, and summaries are assistive tools only. Owners must review the source media, notes, and draft before sending a quote or committing to work.
benny is not responsible for the accuracy of a business's pricing, availability, scope, taxes, permits, disposal requirements, professional duties, or customer contracts. The business remains responsible for final quotes and services provided to customers.
Acceptable use
- Do not use benny to violate law, privacy rights, intellectual property rights, or platform policies.
- Do not reverse engineer, scrape, overload, interfere with, or bypass security for the service.
- Do not use benny to create deceptive, harmful, discriminatory, or unsafe decisions.
- Do not submit malware, credentials, payment card numbers, government identifiers, or unnecessary sensitive personal information.
- Do not represent AI-generated drafts as final prices unless an authorized human has reviewed and approved them.
Third-party services
benny relies on third-party providers for authentication, hosting, database, analytics, AI processing, communications, payments, and similar infrastructure. Their services may be subject to their own terms and privacy practices.
The service may include links to third-party websites or tools. We are not responsible for third-party content, services, or policies.
Plans, billing, and trials
Paid features, included usage, overages, renewal terms, taxes, and cancellation terms will be shown in the dashboard, order form, or checkout flow. Unless stated otherwise, fees are non-refundable except where required by law.
Free trials, previews, or beta features may be changed, limited, suspended, or ended at any time.
Ownership
benny, the website, dashboard, product design, software, workflows, prompts, models, branding, and documentation are owned by benny or its licensors. These Terms do not transfer any ownership rights to you.
If you send feedback, suggestions, or ideas, you allow us to use them without restriction or compensation.
Privacy
Our Privacy Policy explains how we collect, use, share, retain, and protect personal information. By using benny, you also agree to the Privacy Policy.
Availability and changes
We may update, suspend, throttle, or discontinue parts of the service. Some features depend on browser permissions, device capability, network quality, third-party providers, or model availability.
We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify account owners. Continued use after changes means you accept the updated Terms.
Disclaimers
The service is provided as is and as available. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and error-free operation.
benny does not provide legal, tax, accounting, engineering, construction, environmental, safety, or other professional advice. You are responsible for professional review where required.
Limitation of liability
To the fullest extent permitted by law, benny will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost goodwill, loss of data, business interruption, or replacement services.
To the fullest extent permitted by law, benny's total liability for all claims relating to the service will not exceed the amounts you paid to benny for the service in the three months before the event giving rise to the claim, or one hundred dollars if you have not paid benny.
Suspension and termination
You may stop using benny at any time. We may suspend or terminate access if you violate these Terms, create risk for the service or others, fail to pay amounts owed, or use the service in a way that may be unlawful or harmful.
Sections that by their nature should survive termination will survive, including ownership, fees owed, disclaimers, limitations of liability, indemnity, and dispute terms.
Governing law and disputes
Unless a written agreement says otherwise, these Terms are governed by the laws that apply where the benny operating entity is organized, without regard to conflict-of-law rules. Venue for disputes will be the courts located in that jurisdiction unless applicable law requires another forum.
Before filing a claim, you agree to contact us and try to resolve the issue informally. Nothing in these Terms limits rights that cannot be waived under applicable law.
